闖紅燈扯扁案　要求免罰敗訴

【劉志原╱台北報導】陳姓男子去年騎機車行經新北市淡水區，闖紅燈遭警方開罰2700元，陳男認為，自己曾檢舉前總統陳水扁特別費及國務機要費案，其中特別費案已除罪，陳男認為，貪污都能除罪，他只不過是闖紅燈，危害遠比貪污小，被罰屬違憲，提行政訴訟要求免罰，遭法官判敗訴；仍可上訴。
 
陳男認為，特別費案貪污金額百億以上，卻除罪，他闖紅燈應比照免罰，才符合憲法平等原則，法官認為，平等原則運作的基本規則是指，相同事項，應相同處理，不同事項依其特性不同，而作不同處理，首長特別費與駕車闖紅燈二者屬不同事物，陳男闖紅燈遭罰並未違憲。
